Whole Foods boosts 2011 view, shares up (Reuters)

LOS ANGELES (Reuters) ? Upscale grocer Whole Foods Market Inc's (WFM.O) quarterly profit rose a larger-than-expected 35 percent and it raised its full-year profit forecast, fueled by robust sales and snatching market share from other supermarkets.

Shares of the biggest U.S. seller of organic and natural food products rose 3.4 percent in after-hours trade.

Whole Foods' report, issued on Wednesday, eased worries that the sales growth that has driven a healthy 60 percent gain in the stock over the past year could slow.

Net income for the fiscal third quarter ended July 3 rose to $88.5 million, or 50 cents per share, from with $65.7 million, or 38 per share, in the year-earlier period.

Sales rose 11 percent to $2.4 billion. Closely watched identical-store sales, which exclude relocations and expansions, jumped 8.1 percent.

"Sales momentum has been maintained, no doubt about it," said BB&T Capital Markets analyst Andy Wolf, who noted that quarter-to-date identical-store sales at Whole Foods are up 9.3 percent.

Wolf said Whole Foods' upper-end consumers appear to be maintaining their shopping habits despite higher prices for food and fuel.

Other supermarkets do not appear to be faring as well.

Kroger in its latest quarter had a 4.6 percent gain in identical-supermarket sales, while Safeway posted a 0.5 percent rise. Supervalu saw its identical-supermarket sales drop 3.9 percent.

"What you're seeing is a resetting of the market place and right now we are gaining share," Walter Robb, Whole Foods' co-chief executive, told Reuters.

Whole Foods was harder hit than rivals such as Kroger Co (KR.N), Safeway Inc (SWY.N) and Supervalu Inc (SVU.N) when the U.S. economy slid into recession.

The downturn and resulting contraction in consumer spending prompted Whole Foods to revamp its pricing to focus on value. The company, known by some as "Whole Paycheck," has since emphasized lower-priced store brands, rolled out "extreme value" items like wines that sell for around $3 and trumpeted steep one-day discounts on seasonal items like organic blueberries.

Such activities were behind the turnaround at Whole Foods, helping it to keep pace with other large supermarket chains.

Robb said Whole Foods continues to lower prices on some items as it raises prices on others to cover higher costs.

"Price increases have been part of the real world for the last six months," he said. "Every grocery is selectively raising prices right now."

Based on its strong quarterly results, Whole Foods raised its full-year earnings forecast to $1.91 to $1.92 per share from $1.87 to $1.90 per share, previously.

It also forecast fiscal 2012 earnings of $2.21 to $2.26 per share.

Shares of the Austin, Texas-based grocer increased to $67.68 in extended trading after closing the regular session at $65.43.

Mexico nabs top lieutenant of dreaded Zetas cartel (Reuters)

MEXICO CITY (Reuters) ? Mexican police arrested a top lieutenant of the Zetas drug cartel who was linked to the murder of a U.S. immigration agent in February, Mexico's security ministry said on Monday.

Police captured Jesus "El Mamito" Rejon in a Mexico City suburb on Sunday "without firing a shot," the ministry said in a statement.

Rejon is a founding member and currently third in command of the Zetas, which was started by former Mexican special forces soldiers and is considered the country's most brutal cartel.

Turf wars between the Zetas and other cartels have transformed parts of Mexico into lawless killing grounds and scared away some foreign investors.

Rejon was traveling with a Mexico City police officer who was brokering the drug lord's passage through the region, the ministry said. The police officer was also arrested.

Around 40,000 people have died in Mexico's drug wars since President Felipe Calderon took office in December 2006. Calderon has deployed the military to the streets to attack the powerful cartels.

The United States had offered a $5 million dollar reward for Rejon, who the Mexican security ministry said played a role in the shooting of two U.S. Immigration and Customs Enforcement (ICE) agents earlier this year.

The agents were driving in an armored vehicle on a highway from San Luis Potosi to Mexico City in February when they were ambushed in broad daylight by suspected drug gang members.

An ICE agent, Jaime Zapata, was killed and another agent, Victor Avila, was wounded in the leg.

The UK-based human rights group Amnesty International has accused China of suppressing lawyers who become involved in politically-sensitive cases.

It says many have been threatened with suspension or criminal charges.

If these measures fail, the lawyers can face detention - or even just disappear, it says.

Amnesty says the treatment of lawyers has worsened in recent months, after calls in China for Middle East-style protests.

The BBC's Martin Patience in Beijing says Chinese authorities have yet to respond to the allegations in the report, entitled "Against the Law - Crackdown on China's Human Rights Lawyers Deepens".

It highlights the case of one prominent human rights lawyer, Gao Zhisheng, who has been missing for more than a year.

"Human rights lawyers are subject to escalating silencing tactics - from suspension or revoking of licences to harassment, enforced disappearance or even torture," said Catherine Baber, Amnesty International's Asia Pacific Deputy Director.

She said the government's fears of a "Jasmine Revolution" inspired by the Arab Spring have led to the detention of scores of government critics and activists since February.

Amnesty alleges that the Chinese government is rounding up lawyers associated with issues such as freedom of religion, freedom of expression and land rights.

"The Chinese state is attempting to wield and manipulate the law to crush those it perceives as a threat," Ms Baber said.

"Human rights lawyers are being targeted as they try to use the law to protect citizens against the excesses of the state."

Amnesty has called for the release of all those detained for exercising or protecting fundamental rights.

China has said in the past that it is committed to the rule of law. In recent days it has released two high-profile figures from detention.

Hu Jia was freed from jail on Sunday but is being held under conditions akin to house arrest, his wife has reported.

Artist Ai Wei Wei has been freed from detention but faces a gagging order and huge fines for tax evasion.

Murray eyes Wimbeldon semi-finals berth (AFP)

LONDON (AFP) ? Andy Murray's campaign to end Britain's 75-year wait for a Wimbledon men's singles champion continues on Wednesday as he takes on Feliciano Lopez in the quarter-finals while Rafael Nadal battles to overcome a nagging foot injury.

Murray, the fourth seed, sailed into the last eight with a straight sets win over Richard Gasquet and was safely back in his London home when Nadal -- his scheduled semi-final opponent -- suffered a potentially tournament-ending blow.

The world number one suffered the injury in Monday's last 16 win over Juan Martin del Potro and immediately thought his future participation in the tournament was in doubt.

But the 25-year-old later revealed on his Facebook page that he will be fit to tackle Fish on Wednesday.

"Yesterday after the match I went to take an MRI at a London hospital," he said.

"During the match I thought I had something serious. But as the match went on the pain got better and thankfully the tests don't show an injury," he added.

Nadal is due to face American 10th seed Mardy Fish in the quarter-finals where he will be defending a 5-0 career record.

Fish, the only US player left in either the men's or women's singles, had never got beyond the third round before this year.

Nadal's pain could be Murray's gain when Wednesday's quarter-finals swing round.

The fourth seeded Scot reached his fourth consecutive Wimbledon quarter-final with easily his best performance of the tournament and will next tackle Lopez, who he has beaten four times in four meetings.

"Lopez beat Andy Roddick in the last round, straight sets. He serves very well, has a good slice backhand, plays different than a lot of the Spaniards. He likes coming forward a lot," said Murray.

Second seed Novak Djokovic tackles 18-year-old qualifier Bernard Tomic in the last eight with the Australian player the youngest quarter-finalist since Boris Becker in 1986.

"He has great potential and believes he can win against the big players," said Djokovic, who has lost just one of his last 48 matches.
